With family-based sponsorship, certain family members may apply on behalf of a relative depending on their U.S. immigration status and relationship to the beneficiary.

The Immediate Relative category includes spouses, parents, and children under 21 of U.S. Citizens. These family members may immediately file their "green card" application without waiting for a visa number to become available.

Other categories have waiting lists, where the initial family petition can be filed, but the beneficiary must wait to file their actual "green card" application until a visa number becomes available to them. These categories include unmarried children over 21 of U.S. Citizens, spouses and unmarried children over 21 of Permanent Residents, married children of U.S. Citizens, and siblings of adult U.S. Citizens.
